Description

The Intellectual Property (“IP”) Legal Specialist will be responsible for handling all phases of prosecution, maintenance, enforcement and litigation relating to IP, with a heavy emphasis on trademarks and branding. We are looking for a high-performing paralegal who is flexible, adapts well to changes in priorities, and operates with a high level of integrity. Success will require the ability to work independently in a fast-paced environment with little supervision or oversight.

Responsibilities May Include

Responsibilities requiring IP specific experience may include:

  • Conducting clearance searches and summarizing results for proposed new trademarks and taglines

  • Preparing and submitting new trademark and patent applications

  • Preparing and submitting Statements of Use, including evaluating of specimens and proof of use evidence, obtaining declarations of use

  • Assisting with Office Action responses

  • Working with outside counsel, including international counsel

  • Overseeing external docketing service of administrative deadlines for the registration and maintenance of patents and trademarks worldwide

  • Evaluating of trademark and domain name watch reports

  • Preparing and filing extensions of time and Notices of Opposition with the USPTO

  • Preparing and filing UDRP domain name arbitration complaints with oversight from in-house counsel

  • Obtaining legalizations and certifications for filing foreign patents, trademarks and assignments which requires knowledge of Hague Convention Member Countries and in-depth knowledge of global IP law practices and procedures

Responsibilities requiring general paralegal experience may include:

  • Assisting with coordination of brand protection across all business units

  • Drafting Legal Hold Orders

  • Serving as a point of contact for outside counsel and Phillips 66 business units on all assigned cases

  • Maintaining an electronic case file and managing the documents to be retained for each matter

  • Preparing and recording assignment documents

  • Preparing Powers of Attorney for international counsel

  • Preparing IP license agreements

  • Preparing and maintaining non-disclosure agreements

  • Assisting patent attorneys and agents as needed with patent matters, documentation, research and analysis, and taking lead on other specific projects attorneys may assign

Position Requirements

Basic/Required:

  • Legally authorized to work in the job posting country

  • Bachelor's Degree or higher from an accredited university

  • 7 or more years of intellectual property experience in a large law firm or corporation

  • Extensive knowledge of the online filing and database systems at the USPTO

  • Proficiency in Microsoft Office Suite – Word, Outlook, Excel and PowerPoint

Preferred:

  • In-house experience in a Fortune 500 or large publicly-traded company

  • Excellent written and oral communication skills

  • Demonstrated aptitude for technology, with a focus on discovery platforms and databases

  • Comprehensive legal project management skills with a highly developed understanding of intellectual property prosecution, enforcement, trademark opposition and litigation processes

  • Ability to manage and prioritize assignments that may be broad in scope and complexity and that may involve collaborative work with employees

  • and management in other business units

  • Ability to work effectively both independently and in a team environment, work well under pressure, and meet deadlines with little supervision

  • High level analytical skills with the ability to clearly articulate alternatives, recommendations, or proposed solutions

  • Ability to learn quickly and apply Company policies and procedures

  • Experience in the oil & gas (downstream) or chemicals industries.
